What should employers and workers do?

Employer

An employer must take all reasonable steps to assist or provide an injured worker with rehabilitation for the period for which the worker is entitled to compensation. The rehabilitation must be of a suitable standard as prescribed under the Workers' Compensation and Rehabilitation Regulation 2003.

Generally, the employer will offer suitable duties and graduated return to work programs, as appropriate.

Worker

A worker must satisfactorily participate in rehabilitation:

  • as soon as they can after the injury is sustained
  • for the period for which the worker is entitled to compensation.

This generally includes attending and participating in appropriate treatment programs as well as suitable duties or graduated return to work programs.
