Official Policy and Procedure regarding the review process
The documents below are Q-COMP's official position for managing
extension requests and procedural fairness in reviews. We follow
these procedures to ensure we provide prompt and non adversarial
decision making at review.
Policy - Prompt and non-adversarial management of review
applications
This policy outlines relevant considerations to ensure Q-COMP
complies with the legislative requests for a prompt and
non-adversarial review process.
Procedure - Procedural Fairness during the Review
Process
The purpose of this procedure is to outline:
- the principles to be considered by Review Officers where new
information is received during the review process, the disclosure
of information to affected parties and allow the affected parties
an opportunity to respond to the new information prior to the
review decision being made
- the principles to be considered by Review Officers where the
applicant requests an extension of time to provide additional
information in accordance with section 545(4) of the Workers'
Compensation and Rehabilitation Act 2003 (the Act)
- how a review applicant is heard during the review process.
Procedure - deciding a request for an extension of time to lodge an
application for review
The purpose of this procedure is to outline the process to be
undertaken by the Review Unit to determine a request to lodge an
application for review outside the three month time limit in
accordance with section 542(3) of the Workers' Compensation and
Rehabilitation Act 2003.
