Obtaining additional information from insurers

When insurers refer injured workers to the tribunal they must provide all relevant documents from the claim file. The injured worker can also submit copies of any relevant document they would like considered by the tribunal.

However if the tribunal finds additional information is required to make an informed decision, ask the insurer to provide further information.

The insurer must comply with the tribunal's request within a set timeframe. The tribunal may defer its decision until the information is received however it cannot be deferred for longer than three months at a time.

Sometimes the information required may have been left out by mistake and may be sent by the insurer on short notice. If during the pre-reading stage a member identifies additional information is required, the member should immediately contact the Tribunal Coordinator. With sufficient notice often the information can still be obtained in time for the hearing.
