Return to work assist news

Common law

Injured workers with an open common law claim who are referred to Return to work assist are required to satisfactorily participate in the program. This obligation is in accordance with sections 231 and 267 of the Workers' Compensation and Rehabilitation Act 2003 which refers to the common law duty of mitigation of loss.

 

As it has been two years since these legislative provisions were introduced it is timely to conduct a review of these referrals. We want to understand how Return to work assist can effectively engage more of these injured workers into the program and how a successful return to work benefits all scheme stakeholders. The first step is to internally review our procedures in June.
