What happens if your decision is overturned by the Review Unit

Section 545(5) of the Act says a decision by Q-COMP under sections 545(1)(b), 545 (1)(c) or 545(2)(a) is taken to be the decision of the insurer.

If this happens, you must pay the claim in accordance with the Review Unit's decision.

If you decide to appeal the decision, you must still pay the claim until you receive the appeal outcome.

Payment should be made within five business days of receipt of the Review Unit decision, as detailed in the Performance standards and guidelines for Queensland insurers 8.1.

If you are successful at appeal, section 566 of the Act says the worker is not required to repay any compensation received.

The reason for this is the Objects of the Act in Section 5(4)(b), which says workers are to be treated fairly by insurers.
