Return to work assist update

A number of insurers have asked Q-COMP for guidance in whether it is necessary to refer injured workers claims to Q-COMP under s220 in varying situations including the worker's dismissal for reasons that may appear to be unrelated to the claim.

It is not always possible to give a clear answer to all situations, so if you are in any doubt, it is recommended that you contact Return to work assist and refer the matter to Q-COMP for consideration.

Some insurers think that it is not necessary to refer cases where the worker is no longer employed with the same employer, however if the worker proceeds to common law, s267 places an onus on the worker to mitigate his/her loss. The referral will serve to assist in satisfaction of that requirement.
