All Appeals to go to Industrial Relations Commission

On 3 August 2010, the Civil and Criminal Jurisdiction Reform and Modernisation Amendment Bill was passed by Parliament. The Bill contained the first stage of reforms arising from the review of the state's justice system conducted by the Honourable Martin Moynihan AO QC.

The Bill received agreement on 13 August 2010 and on 26 August 2010 the Governor in Council approved the proclamation and set the commencement date to 1 November 2010 for amendment to Part 22 of the Workers' Compensation and Rehabilitation Act 2003. These amendments specifically relate to sections 546(3)(b) and 548A.

Appeals lodged before 1 November 2010 may be lodged with either the Industrial Magistrates Court or Industrial Relations Commission; however from 1 November 2010 all new appeals of review decisions by Q-COMP must be lodged with the Queensland Industrial Relations Commission. The Industrial Magistrates Court will manage and hear (to conclusion) any appeals already before that Court.
