Insurers 'reopening' of claims

Q-COMP treat decisions to 'reject a reopening' the same as a decision to terminate a claim.

As the worker has previously established that they have suffered an 'injury' and met other procedural requirements, from the date the insurer rejects the 'reopening' for any ongoing incapacity or medical treatment and after the insurer has stopped paying benefits, we deem the decision to be one of termination and therefore reviewable.

However, where an insurer 'accepts a reopening', we view that it is the insurer's decision to pay further benefits in relation to an already established claim and therefore such decision are not reviewable.

Applications for review continue to rise

As seen in the graph below applications for review have continued to rise.
